General Terms and Conditions (GTC)

Switzerland

E-Mail: info@telltime.swiss

2. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by private customers via the Telltime GmbH online shop.

The products offered are intended for end customers (B2C). Conflicting terms and conditions of the customer shall not be recognized unless Telltime GmbH has expressly agreed to their validity in writing.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

A purchase contract is concluded as soon as:

  • the customer submits an order in the online shop, and
  • the payment has been successfully completed.

Upon successful completion of the order, the customer receives an order confirmation via email. This confirmation documents receipt of the order, although in some cases it may be generated automatically.

Telltime GmbH reserves the right to reject orders, particularly in cases of obvious pricing errors, technical faults, inability to deliver, or suspected misuse.

4. Ordering process and correction options

Before finally submitting the order, the customer can review, correct, or modify their entries in the shopping cart and at checkout, or cancel the order process, at any time.

Clicking the “Buy Now” button—or a button with a similar label—initiates an order that entails a payment obligation.

5. Prices

All prices are in Swiss francs (CHF).

Where applicable, prices include statutory VAT. Any shipping costs are shown separately during the ordering process before the order is submitted.

Subject to price changes, product modifications, technical changes, and errors.

6. Payment

Payment is made exclusively directly at checkout using the payment methods offered in the shop, in particular:

  • Apple Pay
  • TWINT
  • PostFinance
  • Credit card

Payment by invoice is not offered.

The charge is processed directly via the selected payment service provider during the ordering process. No claim to delivery arises unless payment is successfully completed.

Telltime GmbH reserves the right not to offer certain payment methods, either temporarily or permanently.

7. Delivery and Shipping

Delivery is made to the address within Switzerland specified by the customer.

Delivery times:

  • Standard products: 5–10 working days
  • Products with custom front panels: 10–15 working days

Deviating delivery times are displayed for the respective product.

The stated delivery times are estimates and are non-binding. The customer will be informed of any delays whenever possible.

Should a product be unavailable, Telltime GmbH reserves the right to withdraw from the contract. Any payments already made will be fully refunded.

Partial deliveries are permissible, provided they are reasonable for the customer.

Risk and benefit pass to the customer upon delivery of the goods.

8. Obligation to Inspect, Notice of Defects, and Transport Damage

The customer must inspect the delivered goods as soon as possible after receipt and report any obvious defects or incorrect deliveries to Telltime GmbH without delay—and in any event within 5 calendar days—in writing or by e-mail.

Transport damage should, if possible, be documented immediately upon receipt and promptly reported to the transport service provider and Telltime GmbH.

If obvious defects are not reported in a timely manner, the goods shall be deemed accepted in this regard, to the extent permitted by law.

9. Warranty

For new products, the statutory warranty period of 24 months from receipt of the goods applies.

In particular, the following are not covered by the warranty:

  • normal wear and tear,
  • Wear parts and consumables, where applicable,
  • Damage resulting from improper handling, use or storage,
  • Damage caused by external influences,
  • Damage resulting from unauthorized interventions, modifications, or repairs.

In the event of a defect, Telltime GmbH shall decide at its own discretion whether to provide a remedy, a replacement, an appropriate price reduction, or a refund of the purchase price.

Any further claims by the customer are excluded to the extent permitted by law.

10. Voluntary Right of Withdrawal / Returns

Telltime GmbH grants the customer a voluntary right of withdrawal of 14 calendar days from receipt of the goods.

Conditions for a return:

  • The item is unworn, unused, complete and undamaged.
  • The goods will be returned in their original packaging whenever possible.
  • The revocation is communicated via email to info@telltime.swiss within the time limit.

The customer bears the cost of return shipping.

Upon receipt and inspection of the returned goods, Telltime GmbH will refund the purchase price of the returned item using the original payment method.

Shipping costs for the initial delivery are non-refundable.

Excluded from the voluntary right of withdrawal are:

  • individualized or personalized products,
  • Products manufactured according to customer specifications,
  • used, worn or damaged items,
  • Items that are unsuitable for return due to their nature, provided this has been indicated for the product.

Statutory warranty rights regarding defective goods remain unaffected by the voluntary right of withdrawal.

11. Retention of title

The delivered goods remain the property of Telltime GmbH until full payment has been made.

12. Liability

Telltime GmbH is liable in accordance with statutory provisions for damages caused intentionally or through gross negligence.

In the event of a breach of essential contractual obligations due to slight negligence, Telltime GmbH shall be liable only for damage that is foreseeable and typical of the contract, to the extent permitted by law.

To the extent permitted by law, any further liability is excluded, particularly for indirect damage, consequential damage, loss of profit, loss of data, or damage resulting from delivery delays.

Liability for damages resulting from injury to life, body, or health, as well as liability under mandatory statutory provisions, remains unaffected.

13. Intellectual Property

All content on this website—particularly texts, images, product illustrations, logos, trademarks, designs, and layouts—is legally protected and is the property of Telltime GmbH or the respective rights holders.

Any use without prior written consent is prohibited.

14. Data Protection

The processing of personal data is carried out in accordance with Telltime GmbH’s separate privacy policy in its current version.

15. Applicable Law and Place of Jurisdiction

Swiss law applies exclusively, to the exclusion of any conflict-of-law rules.

To the extent permitted by law, the place of jurisdiction is the registered office of Telltime GmbH.

16. Final Provisions

Should any provision of these General Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Telltime GmbH reserves the right to amend these General Terms and Conditions at any time. The version published on the website at the time of the order shall prevail.
